Article 1

Company Operations

This company establishes these Terms of Use for the purpose of controlling company operations. As a result, all of its activities are conducted within the framework of these Terms of Use. The company reserves the right to amend the content of these Terms of Use at its discretion and without prior notice. Furthermore, by reserving or utilizing the company's services, it is deemed that a contractual relationship is established between you, the customer, and the company, and you are considered to have agreed to all provisions of these Terms of Use.

Article 2

Nature and Scope

The founder of the company, Pedro Fernández Prieto, whose primary business is official tourism guiding, is registered as a self-employed individual under Spanish law. The activities of the company consist primarily of tourist guidance, interpretation, translation, and/or similar services.

About this Website

This website and its constituent elements (including design, logo, text, videos, images, photographs, audio, etc.) are the property of Pedro Fernández Prieto and are protected under the laws of the Kingdom of Spain and international copyright and intellectual property laws. Unauthorized reproduction, reposting, duplication, or any other use of these elements and contents is strictly prohibited.

Article 4

Disclaimer Clause

Please note that, in the event of theft, robbery, food poisoning, illness, accidents causing injury or death, or any other incidents occurring during the use of the services provided by the company, I shall not be held socially or economically liable.

Due to unforeseen circumstances such as inclement weather, floods, fires, earthquakes, typhoons, as well as disruptions caused by strikes, riots, terrorist incidents, construction, etc., changes or cancellations of services may occur. In such cases, the company bears no responsibility whatsoever and will not provide any refunds for service fees.

Furthermore, there may be instances where changes or cancellations of services are necessitated by circumstances beyond our control, including but not limited to factors related to third parties (companies, organizations, institutions, etc.), such as traffic accidents, traffic congestion, show cancellations or changes, or negligence. In such cases, the company shall not be held socially or economically liable and will not provide refunds for service fees. In the event of the aforementioned circumstances, compensation for injuries or damages incurred by customers can only be provided through overseas travel accident insurance. Therefore, to prepare for such risks, the company strongly recommends that customers obtain overseas travel accident insurance.

Article 5

Use of Information

Please note that the information and advice contained on the website and in the emails addressed to our customers are provided for reference purposes only. While the company endeavors to provide the most up-to-date and accurate information possible, local conditions, regulations, and procedures may change, or differences in interpretation may arise. In cases arising from such reasons, the company shall not be held socially or economically liable for any losses or inconveniences incurred as a result of using our website. Additionally, refunds for service fees will not be provided.

Article 6

Information Protection

The company recognises the importance of protecting personal information and considers the appropriate use and protection of personal information to be fundamental to its business activities and a social responsibility. Therefore, when entrusted with personal information, it clarifies the purpose of its use and only use it within the scope of that purpose. Entrusted personal information will not be provided to third parties other than those who have been approved by you, except when fulfilling contractual obligations or when there are other legitimate reasons to do so.

Article 7

Cancellation Policy

If all or part of the services are cancelled by the customer(s), the following cancellation charges will apply:

  • If the service is cancelled more than 14 days before the scheduled date, no cancellation charge will apply.

  • If the service is cancelled between 14 and 7 days before the scheduled date, a cancellation charge of 50% will apply.

  • If the service is cancelled within 7 days or on the day of the scheduled date, a cancellation charge of 100% will apply.

In the event of cancellation, cancellation charges of 100% will apply to expenses already incurred for arranged services (including food and beverage costs, transportation expenses, ticket fees, admission fees, etc). Furthermore, the company reserves the right to change or cancel services based on legitimate reasons (including serious illness). While I strive to notify customers promptly of any changes or cancellations made to services, regardless of the circumstances, the company is not obligated to pay compensation to customers. Please note also that each service departs at its scheduled time. If customers are delayed and unable to participate in the service due to tardiness, no refund of the service fee will be provided.

Article 8

Expenses and Deposits

Please note that expenses other than admission fees, transportation costs, and food and beverage expenses listed in each service (including expenses for the guide and the customer) are not included in the guide fee and will be borne by the customer as separate charges. Madgaido can also handle reservations or arrangements for tickets, restaurants, hotels, shows, transportation, etc. However, in such cases, customers are required to pay the full amount of the related expenses in advance. Additionally, expenses paid in advance for these aspects of the trip will not be refunded under any circumstances.
